    What is the difference between a lawyer and a claims management company?    
    A lawyer is a qualified legal practitioner, either a solicitor, barrister or legal executive, who is regulated by the Law Society, the Bar Council or the Institute of Legal Executives respectively. Claims management companies are not regulated by any of these bodies and usually act as

    How much compensation can I expect to receive?

The Motor Insurers' Bureau (MIB) Back

   
         
    Road Accidents involving Untraced or Uninsured drivers    
   

If you have been injured or your property has been damaged by an uninsured or untraced driver, you may still be able to make a claim for compensation via the Motor Insurers' Bureau or MIB.

The Motor Insurers' Bureau will expect you to have already tried to trace the driver / insurer concerned by reporting the accident to the police, to your own insurance company and making enquiries with the registered owner of the vehicle.

Certain conditions apply to claims made via the Motor Insurers' Bureau such as

•  if the driver of the offending vehicle is untraced, you must at least be able to identify the vehicle to make a claim for property damage. 

•  an excess of £300 will also be deducted from claims made under the untraced driver scheme for property damage after 1st October 1999 (the excess amount was £175 before this date).

•  the Motor Insurers' Bureau will only deal with claims registered with them within 9 months of the accident.  They will also expect the accident to have been reported to the police within 5 days of the accident.

A member of the public wishing to enter a claim with the Motor Insurers' Bureau can either do so directly themselves or appoint a Solicitor to work on their behalf. Top of Page

We will not charge for an initial consultation. At this meeting, you will find out whether you have a case for compensation and be told if there will be a cost should you choose to pursue that claim.

There are a number of ways that legal advice can be funded and Easthams Lawyers will advise you on the most appropriate way for you.

   
         
    Conditional Fee    
    Often referred to as "No win - No Fee". This usually means you need an insurance policy to cover the costs if you lose your case. Easthams will be able to advise you of the cost insurance and whether the cost can be reclaimed if your case is successful.    
    Insurance Cover    
    You may already have Insurance cover which will cover this type of claim. Check with your insurance company.    
    Employee Organisations    
    If you are a member of a union or other employee group, contact your local representative, who may be able to fund your case.    
    Private Funding    
    There are occasions where you may wish to pay for any legal funds yourself    
    Legal Aid
